New Jersey Proposes Making Responsible Gambling Standards Mandatory

Gambling regulators in New Jersey are looking to step up the approach of betting sites in the state to responsible gambling.

The state's Division of Gaming Enforcement (DGE) is proposing to make responsible gambling standards a mandatory requirement for all betting sites seeking to acquire and maintain a licence to operate in the Garden State.

"Ideally, RG tools should be standardized ... and made accessible to patrons across all forms of gaming," the DGE wrote in its Report to the Governor on Responsible Gaming.

"Statewide standardization of RG tools across all regulated forms of gaming in New Jersey is essential for ensuring uniformity in accessibility and implementation. The Task Force recommends further exploration of these areas."

Presently, the undertaking of responsible gambling initiatives is done on a voluntary basis by betting sites operating in New Jersey. However, state regulators feel that this process leads to a hit-and-miss approach. Some betting sites take responsible gambling very seriously. Others provide very little in the way of responsible gambling resources for players.

"Currently, some resources can be accessed online," the DGE noted, "while others require customer service intervention, creating inconsistencies in user experience and tool accessibility."

DGE is looking to create consistent messaging on responsible gambling

The DGE is seeking streamlining of the process. By doing so, the DGE believes that it will make it much easier for anyone who is participating in any form of gambling to easily access assistance if they are developing a problem gambling habit.

"All online platforms offering gaming should be required to include (responsible gambling) messaging and features similar to those that are required for online casino gambling and online sports wagering," the DGE wrote. Among these initiatives, state regulators would require "including the display of RG messaging when logging on and off from an Internet gaming account, deposit limits, time limits, and temporary suspension or 'cool off' periods."

The DGE task force set out to study other jurisdictions to see how they are handling some of these responsible gambling initiatives. But the bottom line, according to New Jersey's state regulators, is to get every gambling operator in the state on the same page when it comes to responsible gambling. And if these operators aren't willing to step up voluntarily, the DGE needs to mandate that they do.

"One way that standardization can be implemented is to require consistent RG messaging across all forms of gaming, including fantasy sports," the DGE noted. "The Task Force recommends that legislation be enacted to require all online gaming operators to display RG messaging and features similar to those that are required in New Jersey for online casino gambling and online sports wagering."

How would New Jersey's proposed responsible gambling standards work?

The DGE proposal for the standardization of responsible gaming initiatives would require operators to automatically review any accounts that set off pre-established triggers indicating there could be a gambling problem. These would include large deposits, such as $10,000 in a single day, or $100,000 over the course of three months.

It would also be the responsibility of each New Jersey operator to appoint a responsible gaming lead. This person would take on the duties of creating and maintaining a list of potential at-risk players on the site. If a problem does arise, then it would be a requirement that the responsible gaming lead contact this person. They must ensure that any at-risk customer gets the problem gambling help that they need.

Failure to do so would lead to penalties instituted by the DGE. In the most serious cases, this could include the shutting down of the site.
